The bill no. 2361 sponsored by Rep. Eileen Cody, (D-West Seattle; 34th Legislative District) on April 16, 2009. This bill prohibits the department of social and health services from paying a home care agency licensed under chapter 70.127 RCW for in-home personal care services provided under the medicaid in-home personal care program if the care is provided to a client by a family member of the client or by an agency employee who resides with the client receiving the care. Requires the department of social and health services to take appropriate enforcement action against a home care agency found to have charged the state for hours of service for which the department is not authorized to pay. Rep. Cody serves as chair of the House Health and Wellness Care Committee and have focused much of my efforts on health care policy -- particularly prescription drug reform. The Bill no. 2361 was referred to the House Ways & Means Committee on April 16, 2009: Substitute offered in the House on April 18, 2009, to remove provisions prohibiting payment when the services are provided by an agency employee who resides with the client, clarifies that the payment prohibition also applies to respite care and to care provided under the developmental disabilities program and authorizes the DSHS to make case-by-case exceptions to the payment prohibition based on the client's health and safety. The substitute passed in the House by voice vote on April 18, 2009. The referral passed in the House by voice vote on April 20, 2009 after referred to the House Rules Committee on April 20, 2009. The Requested to concur in Senate amendments to recede from amendments in April 26, 2009. The amendment passed the final passage by 94 to 2. Gov.
